The Court's judgment of 23 October 2018 in Arjun Gopal v Union of India (Writ Petition (Civil) No. 728 of 2015) restricted manufacture and sale nationwide to green crackers and other reduced-emission crackers, banning conventional high-pollution categories outright. The same order directs PESO, the Petroleum and Explosives Safety Organisation, to ensure that only crackers within the permitted decibel limits reach the market at all.
So the licensing question and the buyer's question are different things: a licensed, PESO-compliant seller carries the legal burden of stocking only green crackers within the noise limit, and a buyer's job is simply to buy from one, not to hold paperwork of their own.
