No single national answer exists: the Supreme Court's 23 October 2018 order permits only green crackers across every state, the NGT bans all crackers wherever air quality is "poor" or worse, and individual states add their own yearly rules on top — Delhi has repeatedly gone further. The Detail
Three layers apply. First, the national floor: the Supreme Court's judgment dated 23 October 2018 in Arjun Gopal v Union of India (Writ Petition (Civil) No. 728 of 2015) restricted manufacture and sale nationwide to green crackers, banning conventional high-pollution categories. In November 2023 the Court clarified that this applies across all states, not just Delhi-NCR.
Second, the air-quality trigger: the National Green Tribunal, in orders dated 9 November and 1 December 2020 (O.A. No. 249/2020), limited sale and use to green crackers within a two-hour festival window wherever average air quality reads "moderate" or below, and directed a total ban on all firecrackers where air quality is "poor" or worse.
Third, the local layer: state governments, UTs and city pollution bodies issue their own notifications each season. Delhi has repeatedly gone further, banning manufacture, storage, sale and bursting of every category through its Pollution Control Committee. These notifications are reissued yearly, so last Diwali's rule can't be assumed to still hold.
